All the products sold by berrybelly through this site are sold subject to these terms of use. By submitting your order for processing in berrybelly you confirm and affirm that you have read, understood and agreed to the terms of use in the form in which they appear at the time your order is submitted for processing. These terms of use shall be read in conjunction with the legal notice and shall prevail over any other document purporting to have a contractual effect.
When making an order
The customer shall provide berrybelly with complete and updated information, which shall include (but shall not be limited to) the customer's legal name, home address, delivery address and telephone numbers.
berrybelly shall make every effort to fulfill orders placed by customers through the berrybelly website, but berrybelly shall not be liable to any person if berrybelly shall decline to fulfill an order for whatever reason, or if berrybelly is unable to supply an order because of an unforeseen change to the products (as the case may be), or because the products may be unavailable.
berrybelly reserves the right to decline or reject any order it may consider unreliable upon having checked the payment details submitted for that particular order.
berrybelly has reserved the right not to accept any order which berrybelly deems to be invalid and to charge on logistic cost for any returned goods wrongly ordered by customers.
Price
berrybelly shall make every effort to ensure that the prices, details and sizes of products detailed on the website are correct but we reserve the right to vary the price and other details of the products without notice.
The prices advertised on the website are for on-line shopping only. The price of certain product is subject to market fluctuation and is offered for guidance or reference only. The final selling price will be subjected to order confirmation by berrybelly
Discrepancies between the on-line bill and the final bill may be due to daily price changes. berrybelly reserves the right to adjust the final bill and such adjustments shall be marked on the final bill presented to the customer at the time of delivery.
If the customer requests a variation to the order which berrybelly accepts then the price payable for the order will be adjusted accordingly to reflect the variation and shall be recorded on the final bill presented to the customer at the time of delivery.
We reserve the right to alter or amend the credit charges, to withdraw credit, to accept or reject orders, to refuse applications or with prior written notice to close an account.
Payment
Unless with prior approval from berrybelly, payment for products ordered through our website can be only made by cash or bank transfer.
berrybelly may change at any time the method by which payments for berrybelly online orders may be effected and such changes may be notified to by placing a notice to this effect on the website.
Delivery
Your order will be delivered by the China Post or courier. International orders will be delivered by the most reliable carrier service available. We are not responsible for any loss, damage, or delays through any sort of carrier services.

Products delivered within Shanghai center should arrive within 3 days following payment authorization. Delivery outside Shanghai center or international orders may take longer depending on the location.
Availability
All orders for products are subject to availability.
Color Reproduction
berrybelly takes great care with colors used in the collections. The limitations of color reproduction and the individual color setting of your screen may mean a slight variation. Every reasonable care has been taken to ensure that the descriptions are accurate. However, specifications may change.
Property Risk
All risk in the products shall pass to the customer upon delivery to the customer’s delivery address, but berrybelly shall retain the title rights and interest in the products until such time as payment for the products has be effected.
Return & Exchange
Not all pictures of products on this site will correspond exactly to product description. In such cases the written description of the product is more accurate, and information given by agency will be final. The customer shall not be entitled to return a product simply because it does not correspond exactly to its online picture.
If any product proves to have been delivered in a damaged condition, or if a product ordered is not included in the delivery, or if the wrong product is delivered, customers shall report the case through our customer service hotline within 7 days after delivery. I If any product delivered to the customer by mistake, berrybelly reserves the right to collect the wrong product.
We do not exchange or refund any paid items for any reasons.
Liability
The liability of berrybelly (to the extent permitted by law) whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the products or any other breach of berrybelly obligations hereunder shall not in any event exceed an amount equivalent to the price of the product.
berrybelly shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever nor shall berrybelly be liable for any damage or loss caused by the customer's servants, delivery agents, buyers or other persons whatsoever.
The customer shall ensure that the products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the products. The customer expressly acknowledges and agrees that berrybelly assumes no obligation or liability for any advice or information given with the products and berrybelly shall not be responsible for any inaccuracy or misstatement of any such information. The products shall be accepted by the customer entirely at the customer's own risk.
Force Majeure
If the performance by berrybelly of its obligations is prevented by reason of “force majeure”(which shall include prevention occasioned by fire, casualty, accident, act of God, natural disaster, any law, order, proclamation, regulation, demand or requirement of the Chinese Government or of any of its government agencies, strikes, labor disputes, shortage of labor or lack of skilled labor, shortage or unavailability of products or raw materials, delay in transit or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of berrybelly), berrybelly shall be excused from such performance to the extent of such prevention, and berrybelly shall have no liability whatsoever towards the customer.
